Premier League - Curbishley wins West Ham case

Alan Curbishley has won his case for wrongful dismissal against West Ham after claiming he had no option but to resign.

A Premier League arbitration tribunal has upheld Curbishley's claim for wrongful dismissal after he resigned last season following the club's decision to sell Anton Ferdinand and George McCartney to Sunderland against his wishes.

Curbishley said: "I am obviously delighted with this result. I very much enjoyed my time at West Ham and never wanted to leave, but on joining the club I insisted that my contract contained a clause confirming that I would have final say on the selection of players to be transferred to and from the club."

He added: "The club completely ignored my contract when selling Anton Ferdinand, and when George McCartney was then sold, the club having given me assurances that no players would be leaving the club after the sale of Anton Ferdinand, I had no alternative but to resign.

"My authority and integrity were undermined and my position was made untenable. I now wish to put this entire matter behind me."

The tribunal, which dismissed a counter claim from West Ham, will now assess how much compensation the club will have to pay.

  1. I still cant see that he has a case for wrongful­ dismissal if he was not sacked. He could claim for­ breach of contract with a clause in his contract being­ ignored, but not wrongful dismissal as he was not­ dismissed. I admit to not being a legal expert, but­ surely a claim has to fit what it is called? Alan­ Curbishley himself says he resigned due to a breach in­ his contract, no one has ever claimed he was sacked. ­ This feels like blame culture gone too far. In­ response to comment number 5 Curbishley bought in­ INJURED English players who can only have played a­ handful of games between them while Curbishley was at­ the club.

This is ONE MORE confirmation that executive Duxbury is­ a MENACE to West Ham and should be sacked IMMEDIATELY. ­ DUXBURY was responsible for the whole Tevez saga, for­ the money Hammers lost at tribunals, for the £10m­ Freddie Ludeburg cost Hammers, etc etc etc. He has been­ interfering with Zola running of the team too, He still­ pays Joorabchian as a 'transfer advisor', the­ man who cost hamers so much. Now Hammers will be­ ordered to pay out over Curbs, money that should be­ available for getting good players. GET RID OF HIM­ NOW!!!!!!

  10. I cannot make out the situation at West Ham. It seems­ that whatever we do we F uck up.
    The Tevez debacle, the­ inflated wages paid to ordinary players etc. I read an­ article that claimed our wage bill was above £60m a­ year. One of the highest in the EPL. Who is getting the­ big bucks?? Why is Ashton still on the pay role? We­ should claim on the insurance. (If we have any. What­ is NANI doing at the club. Ship him out. Next we will­ be investigated how we paid inflated price to Brescia­ where I believe Nani's father in law is president­ for Salvio. I read that Zola thought he was not ready­ at all for the EPL. West ham were not in a position to­ speculate on Future Stars. It needs players for Today.­ (Unless the plan was to park him with a view to a move­ to Chelski)

  14. I am a west ham fan and I am totally on Curbishleys­ side for this. I believe he is a way better manager­ than zola and he should have stayed. Our load of idiots­ (scott duxbury and nani guy) are idiots and should be­ sacked, alongside anyone who went against curbishley!­ We had good english players brought into the club when­ we was there, we finished 10th after staying up and we­ looked good at the start of that season! What has­ Zola/nani done? Just sold our good english players, and­ bought old, foreign imports that are not even worthy of­ the hammers shirt!!
    Hope we don't go down but i­ fear we might have to to get our club sorted again!!!
