The 30-year-old England all-rounder will be represented by renowned solicitor Nick Freeman, who is known as 'Mr Loophole' for his ability to successfully defend stars.
In 1999, Freeman successfully defended Sir Alex Ferguson, who was caught driving down the motorway hard shoulder - he was rushing to find a lavatory, said Mr Freeman.
The celebrity lawyer has also defended David Beckham, snooker's Ronnie O'Sullivan, the model Caprice and a host of other celebrities.
It is alleged Lancashire star Flintoff was clocked driving at 87mph in a temporary 50mph zone of the M62, said a spokesman for Mr Freeman.
The offence is alleged to have happened on July 1, 2007.
Flintoff, a father of three, who lives in Altrincham, Cheshire, will appear at Liverpool Magistrates' Court at 2pm.
