CAS postpones hearing in Valverde doping case

GENEVA (AFP) - The Court of Arbitration of Sport (CAS) said on Monday that it had postponed a hearing into Spanish cyclist Alejandro Valverde's appeal against a doping ban that sidelined him from this year's Tour de France.

The hearing into the two year suspension on Italian soil imposed by the Italian national Olympic committee (CONI) had been scheduled for November 16.

But CAS said the International Cycling Union (UCI) and the World Anti-Doping Agency (WADA) had recently been allowed to join the case, delaying the procedure.

"As a consequence, all parties concerned have agreed to postpone the hearing that was initially fixed for 16 November 2009," it added.

"The UCI and WADA will have the opportunity to file written submissions and a new hearing date will be fixed as soon as possible."

CONI claim a blood sample taken from the Spaniard at the Tour de France when it passed through Italy in 2008 matched DNA from a blood bag seized during the 'Operation Puerto' doping scandal that erupted in May 2006.

As a result of the ban, Valverde was unable to take part in this year's Tour because part of it briefly passed through Italy during stage 16.

The Lausanne-based court also said that another hearing involving Valverde, this time on an appeal by the UCI and WADA seeking to force the Spanish cycling federation to open a doping case against him, was "unlikely to take place before the end of the year."

UCI chief Pat McQuaid belives that Valverde was implicated in the Operation Puerto doping scandal which erupted in May 2006.

McQuaid has said he was waiting for the CAS rulings on both appeals before he would seek to expand the Italian ban worldwide.

Valverde has protested his innocence ever since being linked, belatedly, to Operation Puerto.

  3. I'm concerned that the drug enforcement agencies in­ Italy, Spain, and France can't work together?
    If a­ rider is found guilty of drug use (with credible,­ verifiable evidence), then other countries should­ acknowledge this guilt and ban the rider also.

    The­ policy that I can't ride in events in Italy, but I­ can ride in events everywhere else is not good for the­ sport of cycling, let alone the cyclists.

We take your point, all you­ wrote/said is completely true-we all know these facts­ and you don't need to repeat millions of times.­ Pharmastrong and the others are good sell and we are­ harmless either to them either to NIKE, TREK etc...­ Regarding Valverde's case and his innocence, think­ that best way he prove his clearness was his victory on­ Vuelta few months ago. Sad for his absence on 2009TdF,­ but can't wait to see his performance next 2010 on­ this race. "Dirty" or not Valverde stays as­ one of the best men on a bicycle in this era. We all­ cycling-fans must make the difference between the sport­ itself, riders and the governing bodies and race­ organizers. There are many different levels to follow­ and watch this sport(among many other sports) and­ focusing on a top level as TdF GT's, WC's etc.­ surely means a lot of money in stake and slightly­ bigger commercial influence in all aspects. What all­ that brings to the sport is another question and there­ is no sport immune to these demands in means of­ results, achievement etc. Anywhere where we look for a­ higher, faster, longer, there will always be place for­ enhancement substances, inhibitors, stimulants etc.­ False victories are numerous in the past 20y. and­ personally is disgusting to me, and understand fans­ disappointment, but there are true champions amongst­ them which we truly must cheer and celebrate-these two­ spaniards Valverde and Contador seems as right one, so­ we could believe in their victories. At least to the­ next OP...

  16. Is it not time to draw a line under all these­ "retro" implications, especially those­ involving cyclists and Operación Puerto. It is a fact­ that only cyclists seem to have been singled out (in­ public at least) whilst it is also common knowledge­ that around 200 other sports men and women, some very­ prominent, were also found listed but who have never­ been publicly exposed. This spells persecution against­ cyclists and an anti-cycling feast for the media.­ Drawing a line underneath this will then enable WADA,­ UCI, FIFA, athletics, tennis, swimming etc etc to get­ their respective anti-doping houses in order and make a­ new, and FAIR start on the anti-doping campaign IN ALL­ SPORTS.

  17. Frankly, I've lost all faith in the UCI, WADA, CONI­ and whoever else is invlolved. This is pure farce. ­ Any lawyer worth his salt will pull this case to pieces­ and discredit all involved, such is the level of­ incompetance in both undertaking the investigation and­ administering appropriate punishment. Sadly (for­ Valverde at least), whatever happens, he'll be­ labelled as a dirty rider. Scandalous.

  18. was contador implicated or was it that his training­ times found in documents relating to his team (which­ was full of dopers) had his mane on it. nothing medical­ has been linked to him, just training times. Even so­ how did he win the 2007 tour when those around him were­ doping, does he have a VO2 max over 100? Its the lack­ of clarity, the mistrust, the rumours. The UCI needs to­ up its game on dopers, as does WADA because a great­ sport is still ruined by mistrust. Blood passports are­ ok for finding epo if used in large doses. but it does­ nothing for growth hormes, micro dosing EPO, little for­ off season testing, etc. Its too easy to cheat. The­ question is why would you not dope if those around you­ did. Make val do a DNA test or suspend his licence.­ Make him prove he is NOT implicated in porto.
