Stoke defender Robert Huth has been charged with violent conduct by the Football Association over an incident involving West Ham defender Matthew Upson on Saturday.
Huth appeared to swing an arm into Upson's face as the pair jostled for position at a free-kick, but the incident went unnoticed by referee Martin Atkinson.
Huth has until 6pm Tuesday to respond to the charge, which will be considered by a regulatory commission on Thursday.
Stoke were leading 2-1 at the time and held on for the victory to end a run of four matches without a win.
Speaking after the game, Stoke manager Tony Pulis said: "I will have a look at it and obviously if he has done it we will speak to him and deal with him in-house."
West Ham manager Gianfranco Zola added: "I saw the incident. Matthew is okay now, he had a few stitches.
"Looking at the video after the match obviously it was a sending off. I can only assume the referee didn't see it.
"I haven't spoken to the referee about it. I don't think I need to talk to him. It is down to the authorities to decide (whether further action is required) - it won't change the story for me."

guys if I was huth I would have decked upson he was at him all game. you were soundly beaten by a better side. your team has no shape and you looked beaten
If i were Upson.. huth would be a marked man!!
Clubs should be docked points at the end of a season for their Red and Yellow cards.
If all clubs, Hammers included, lost a point for a yellow and three for a red we would see a much cleaner game with no dissent. I know this seems extreme but it would work, if it didn't teams like Hull would end up with minus points every year.
The Hammers should have had aPenalty....we needed the point....we woz robbed.The Ref and lino need glasses to miss that1 Scandalous!...descisions likethis acn cost us this season.Come on west Ham...bring on the Buyout.
