Lewis Hamilton said he was disappointed but not depressed after a court rejected McLaren's appeal to have the Formula One leader reinstated as Belgian Grand Prix winner.
The decision left the 23-year-old Briton just one point clear of Ferrari's Brazilian Felipe Massa with four races remaining.
The governing FIA said in a statement that the court of five judges had "concluded that the appeal is inadmissible" after Hamilton gave his version of events at the hearing in Paris on Monday.
"Article 152 of the International Sporting Code states that drive-through penalties are 'not susceptible to appeal'," the FIA added.
Hamilton, who was demoted from first to third at Spa-Francorchamps in the September 7 race after cutting a chicane, will now start Sunday's Singapore Grand Prix with 78 points to 77 for Massa.
Had McLaren's appeal been successful, Hamilton would have had a seven point advantage.
"People will probably expect me to be depressed about today's result, but that isn't me," he said in a McLaren statement.
"All I want to do now is put this matter behind me and get on with what we drivers do best - racing each other. We're racers, we're naturally competitive, and we love to overtake.
"Overtaking is difficult, and it feels great when you manage to pull off a great passing manoeuvre. If it pleases the spectators and TV viewers, it's better still. So I'm disappointed, yes, but not depressed."
A Ferrari spokesman said the Italian team would not be commenting on the verdict.
The race at Spa was a thriller but the excitement fell flat when stewards later ruled that Hamilton had gained an advantage by cutting the Bus Stop chicane while duelling with Ferrari's Kimi Raikkonen for the lead in the closing stages.
They imposed a retrospective drive-through penalty, translated into 25 seconds added to Hamilton's total time, which dropped him from first to third.
Massa, who had finished second, was awarded his fifth win of the season instead.
Hamilton, who had handed back the position gained before overtaking Raikkonen again into the next corner, told the court in Paris he felt he had acted according to the rules.
McLaren had also pointed out to the court that race control had twice given Hamilton the all-clear at the time.
"We are naturally disappointed with today's verdict, and to have received no ruling on the substance of our appeal," said McLaren chief executive Martin Whitmarsh.
"No-one wants to win grands prix in court but we felt that Lewis had won the Belgian Grand Prix, on track, in an exciting and impressive manner.
"Our legal team and witnesses calmly explained this, as well as our belief that the appeal should be admissible, to the FIA International Court of Appeal," he added.
Hamilton arrived in Singapore on Tuesday, where he chatted and joked with fans while watching youngsters drive an F1 simulator in one of the city-state's plushest shopping centres.
Dressed in a grey suit, the driver told the crowd he was fully focused and looking forward to the sport's first night race.

Just to put you right, rbrtmurphy, Hamilton was NOT pushed offline at the chicane. The car being overtaken has the right to keep to the driving line as long as the overtaking car is not well in front. You could see that Hamilton was NOT well in front and therefore should have lifted off and tried again later. The whole incident was brought about because of Hamilton's inexperience and arrogance and McLaren tried to justify when all along they knew he was at fault. Why would they ask Charlie Whiting for an opinion if they thought it was OK? Because they could put him on the spot and, if he said 'It LOOKED ok', they could use it as an excuse. Who was caught cheating last year?
next years uk f1 race needs to have lots of "GO HOME FERRARI YOUR NOT WELCOME" banners in the stands, that will tell them how the fans in the uk feel about them. did kimi get greif for going around the outside of the track on a corner? did this allow him to build up speed? he was clearly out classed and unable to controle his car in the wet and deserved to hit the wall.

COMMON MCLAREN
I'm a Ferrari fan, but the only way is to put the sand within the chicanes once again (as it was some years ago). In this way, none of the pilot could easily make what's happened.
Do you remember Lewis last year with the flat tire in the sand loosing his title?He did the risk, and he payed for himself.
The right thing to do for me, is not to punish the hazard of a pilot, but simply make the way that they can't do that!
Lewis deserved to win the Belgian GP or at least they should have gave him the pass-through during the race as well.
Punishing him after that race, is somekind of a "farce" that damage Ferrari's reputation as well.

OK, can someone please clarify this for me. Mclaren were denied an appeal on grounds that their evidence was see as inadmissable. Ok i get that bit.
But i'm having difficulty understanding why McLaren have to pay for the appeals fees. Now they were denied an appeal, so what is there to pay for.
I think that alot of people who are looking at this appeal are forgetting the fact that Lewis Hamilton was if you like pushed off line at the cicain and had the instinct in him to cut it in an effort to avoid a collision, surely a colision would have been more problematic to both teams, ok it put him in front of Kimi but he did as he was supposed to and handed the position back, then made his move to overtake again. The fact that the Ferrari's cant acctually out perform the Mclaren in the wet seems to have been overlooked...... Give Lewis his due he drove the race magnificently and should have kept that first place.
How many of us knew about or were clear about this "rule" before the incident at Spa?How many rules have the FIA got in place that are vague and "bendable" into a shape that suits them?That to me is the real point.Would it be acceptable in the Premier League if the fans were not clearly aware of the offside rule?
Also how dare they maintain that a referee's decision is not subject to appeal?It is in every other sport,and it should be in Motorsport.Life is at times unfair.We all know that,and that is why there are effective appeals procedures in the first place.The FIA is looking even worse than it did after Spa.They allow a hearing and then say,after the hearing,that the subject of that hearing was not "susceptible" to a hearing.If this is not an abuse of human rights and dignity in itself,isn't it laughable?Max Mosely went to court to defend his human rights and dignity didn't he?

Mclaren are the cheats.Before they stole the 600 page design dossier on ferarri they were 2&3 quarters of a second a lap behind.Any one that knows anything about F1 knows full well you dont gain that much from 1 season to the next.Also every single F1 driver that dont drive for mclaren agreed with the FIA's decision that Hamilton had taken an advantage. I suppose they are all Ferarri fans as well.Look at the evidence on TV,Hamilton allowed Raikonen to regain his position by putting himself into Raikonen's slip stream.This would not have happened if he had gone around the chicane like Raikonen did! So please stop being brain washed by ITV sport or should they call it the Lewis Hamilton bum licking show! Its time to get honest ,F1 loving,none bias commentators back [come back murray whalker all is forgiven]we might get to hear about other F1 drivers and teams .
