Sheffield United have won a High Court battle with West Ham in the Carlos Tevez saga.
Mr Justice Teare granted a temporary order stopping the Hammers appealing to the Court of Arbitration for Sport (CAS) over a ruling that they had breached Premier League rules in signing the Argentinian.
This will allow the Blades to go ahead with their arbitration claim for damages over their relegation from the Premier League last season.
The court battle over whether the arbitration tribunal's findings can be appealed to the CAS is expected to return to the High Court for a full trial next year, when Sheffield United will be seeking a permanent injunction.
An independent tribunal ruled that Tevez was not eligible to play for West Ham at the end of the 2006-07 season.
The Argentinian, who now plays for Manchester United, was deemed to have played a key part in the London club's Premier League survival as the Blades were relegated.
The South Yorkshire club are expected to claim up to £30million from the Hammers, but this will be assessed at a future arbitration hearing in private.
The Blades went to the High Court to stop West Ham appealing against the arbitration tribunal's findings that hiring Tevez was in breach of Premier League rules - and the South Yorkshire club were entitled to recover damages.
When West Ham filed an appeal from the arbitration decision to the Court of Arbitration for Sport in Switzerland, the Blades claimed this was a breach of the arbitration agreement between the clubs and that the CAS had no jurisdiction to hear such an appeal.
The judge granted Sheffield United's application for a temporary order restraining West Ham from taking any further steps to pursue an appeal or challenge the tribunal's findings other than by way of an application to the High Court.

Why not let the two teams play a match to decide who pays up or shuts up.
They say that Tevez was worth 3 points to West Ham and saved them from relegation. How many points is an England International worth over a season ?. Dean Ashton was injured whilst on duty with the Football Associations England team at the beginning of that seasonand missed the whole season. If we had had him in our side he would have scored 10/15 goals at least and therefore would had been worth at least 3 points. Does this mean that we can make a claim against the FA for any monies we need to pay out to Sheffile United ??

i am a west ham fan, i sympathise with sheff utd but you cant blame your whole dismal season and relegation on one player? WHU played as a "team" the whole season especially towards the end, yes tevez scored some goals, but he was not the only player on the pitch!! you only needed a draw to stay up, we needed to beat MAN UTD!! WHU have already paid (£5.5 million) for what they did, surely the law states "you cannot be tried for the same crime, twice"? this whole fiasco is a joke!!

West ham cheated full stop.Yes United did not do well enough to stay up.Has for the lousy 5.5million pound fine which west ham fans think is alot,just a drop in the ocean,where was the 15 point penalty demotin.Look at rotherham,luton little less known clubs which have been hammered by the usless and bully like run london FA,yet west ham had 2 illigal players.I think youre grinnin big time real west ham fans no they have got away with it upto now,no legs to stand on justice is coming.
How come Sheff Utd can claim West Ham will breach the rules by going to CAS, and get them stopped from doing so, when they breached the FA rule saying they weren't allowed to take it further after the £5.5m fine WH paid???
If the FA weren't such obvious tossers, they would threaten Sheff Utd with a fine that equals whatever they are awarded for thier earlier rule breach!
This whole episode is so sickeningly greed oriented and absolutely nothing to do with football.
I think it is about time the real villains of the case,the F.A and Football League stepped into the frame.West Ham have paid the fine levied and accepted their punishment meted out by the arbtration panel,Sheffield United should be suspended from the Football League for bringing the game into disrepute by their constant whining that they would have stayed in th P.L,they are not good enough now and they weren't then.And yes i am a west ham fan.
Sheffield United were relegated thanks to Tevez almost single-handedly bolstering a westham team who would have dropped to the Championship if it wasn't for his qualities and for the vital goals he scored, especially towards the end of the season. As a Fulham fan, I wish the Blades all the best as this illegal situation continues to be under scrutiny, the only fair outcome being the demotion of westham and reinstatement of Sheff U, plus heavy fine. Cheating should not be tolerated, and the powers to be must make a precedent to make sure this doesn't happen again. Furthermore I would like to see the other relegation candidates (including Fulham) offer their support to the blades, as it could of been one of us cheated of top flight football. Good luck the Blades.
At the end of the day, Sheffield United are where they are due to their underperformance. You can't expect to stay in the top stage with performances of a 2nd Division outfit. That is how things are in the real world. All those complainers have nothing but sour grapes. Mr Tevez must be enjoying the attention that he is getting whilst on his overinflated salary with Manchester United. The whole English league is nothing but a circus run by foreigners.

the only reason Sheffield United are runnin to the courts for this,
is because, they are having big financial troubles, therefore they found a loop hole so that they can get some cash to pay their bills
if they dont, you might get another Leeds United or Gretna. i understand why their doing it even if it is outrageous
survival of the fittest. they werent fit enough to stay in the prem. theyre tryin to survive economically
