Held in front of Judge Mr Jan Stovicek, the International Disciplinary Court found that Sykes had not infringed regulations when he re-joined the circuit at La Roggia and he 'used the route indicated and returned to the track at the prescribed spot'.
After hearing the evidence, Judge Stovicek rejected the appeal by Sylvain Guintoli and Aprilia after the intial decision by race direction, and the record books will show Sykes as finishing third instead of fourth.
This now means Sykes' series lead will increase by three points to 290 while Guintoli's reduces to 283. The remain one-two in the championship standings.
